Teacher Usage Commitment and Data Processing Agreement

In short: You commit that you will not share any child in a recognizable way without the parents' explicit consent, that you will inform your school management, and that you will not use these features in place of official correspondence. Motivasyon TV, in turn, commits to process student data only on your instructions, to protect it, to notify you of a breach immediately and to delete it when the account is closed. Your acceptance is recorded together with its time, the version of this text and your account.

1. Parties and subject

This text sets out, between the teacher using a teacher (class) account on Motivasyon TV ("Teacher") and Motivasyon TV (operator: Erhan Dursun, contact: [email protected]) ("Motivasyon TV"), the commitments regarding the use of the class journal, teacher–parent messaging and student portfolio features and the personal data processed within this scope, and the data processing conditions under Article 12 of KVKK (Law No. 6698). With respect to class data, the Teacher acts on behalf of and under the responsibility of the school / institution where they work ("School"); the data controller obligations in this text are assumed by the Teacher on behalf of the School and are also valid towards the School.

2. Roles

Data controller: The School (through the Teacher). The Teacher decides the purpose of processing and which data to share.
Data processor: Motivasyon TV. Processes data only to provide the service and in line with the instructions given through the Teacher's actions in the app.

3. The Teacher's commitments

No recognizable sharing without consent. I will not photograph or share in a way that their face or identity can be recognized any child whose parent's photo sharing explicit consent is not active. For children whose consent status in the app shows "no permission" or "awaiting answer", I will blur their face or not share the photo. For every post with a photo, I confirm that I have tagged every recognizable child or covered their face; I am responsible for the accuracy of this confirmation.
Faceless sharing first. Whenever possible, I will share work, activities and the classroom environment without showing children's faces.
If consent is withdrawn. When posts are suspended because a parent has withdrawn consent, I will remove their photos or delete the post without delay.
No sensitive information. I will not share students' health, disciplinary, grade, exam result, reason for absence, family situation or similar information in the class journal; in one-to-one messages too, I will write only with that student's parent and only as far as necessary. I will not enter Turkish national ID numbers, addresses or phone numbers.
Only my own student and their parent. I will not pass a student's information to another parent, to the parent of another student or outside the class.
School management informed. Before starting to use these features, I have informed or will inform the school principal's office; if the school management does not allow the use, I will not use them. If the school has its own information notice and consent processes, I will comply with them.
Compliance with Ministry of National Education (MEB) rules. I will comply with the Ministry of National Education's instructions on the protection of personal data: I will not publish students' photos and videos on the school's website, social media accounts or public platforms; if filming is necessary for an educational activity, I will obtain the parent's explicit consent. Even though posts in this app are in a closed space, they do not replace these rules.
Not an official channel. I will not use these features for official correspondence, official data requests or formal notifications; for official announcements and information I will use the official channels of the Ministry and the school (e.g. the e-Okul Parent Information System).
Archives I download. I will keep the class journal archive (ZIP) and message exports only for my own record-keeping and proof needs, on a secure device; I will not share them with third parties and I will delete them when they are no longer needed.
Account security. I will not share my account password with anyone; I will not leave my session open on shared devices (e.g. the staff room computer). If I notice that my account has been used without authorization, I will report it immediately to [email protected].
Respectful communication and quiet hours. I will write to parents in a respectful and professional tone. The quiet hours setting only holds notifications sent to me; I will also take care to write to parents at reasonable hours. In case of harassment, threats or inappropriate content, I will use the block and report tools.
Passing on parents' requests. If a parent wishes to exercise their rights under KVKK Art. 11, I will pass the request on to the school management and, if necessary, delete the content from the app.

4. Motivasyon TV's obligations as data processor (KVKK Art. 12)

Processing on instructions. Processes student and parent data only to provide these features and in line with the Teacher's instructions; does not use it for advertising, marketing, profiling, sale or artificial intelligence training.
Confidentiality. Data is accessed only by persons under a confidentiality obligation, and only to the extent strictly necessary to operate the service and resolve support requests.
Technical and administrative security measures.
- All connections are encrypted with HTTPS (TLS); passwords are stored salted with scrypt.
- Each request is authorized with a session or a personal link key; the teacher sees only their own class, and the parent only their own child. There is no messaging between parents and no groups.
- Photos are not kept in a public folder but in the app's data folder; they are served only through signed addresses that are valid for at most 15 minutes and specific to the viewer, with authorization checked again on every request. Responses are closed to search engines (noindex) and are not stored in shared caches.
- Photos are re-encoded in the browser; EXIF/XMP/IPTC sections carrying location (GPS) and device information are additionally stripped on the server. Only JPEG, PNG and WebP are accepted; the content type is verified from the file itself; there is a limit of 1.5 MB per file and 2 GB per class.
- Photo sharing consent, information notice and commitment acceptances are recorded with versions; when a text changes, acceptance is requested again.
- Rate and sending limits are applied; personal parent link keys are not kept in server logs; IP records are kept for at most 14 days.
- Data whose retention period has expired is deleted automatically and permanently in the background (see the Data Retention and Destruction Policy); the database is backed up daily, and backups are renewed within at most 30 days.

Sub-processors. Motivasyon TV uses only the service providers below; before adding a new sub-processor, it updates this page and informs teachers in the app:

Because these providers do not yet offer the standard contract announced by the Turkish Personal Data Protection Board and there is no adequacy decision for the countries data is transferred to, a transition to hosting personal data in Turkey has been started for full compliance with KVKK Art. 9. Until the transition is complete, data is processed with these providers over encrypted connections and with the technical and administrative measures described in this text; this text will be updated when the transition is complete.

Data breach notification. Motivasyon TV notifies the Teacher (at the account's email address and in the app) of a data breach affecting class data without delay and within 24 hours at the latest from the moment it learns of it; it shares the nature of the breach, the data and number of people affected, its possible consequences and the measures taken. In this way it supports the School, as data controller, in notifying the Board within 72 hours from the moment it learns of the breach, in accordance with the Personal Data Protection Board's decision dated 24.01.2019 and numbered 2019/10, and the parents concerned as soon as possible. For family account data, Motivasyon TV is the data controller and therefore notifies the Board itself within 72 hours.
Support with data subject requests. Forwards Art. 11 requests from parents to the School; on the School's instructions, carries out deletion, correction and information actions without delay.
Audit. The Teacher or the School may request written information on the measures in this text; Motivasyon TV replies within a reasonable time.
End of the agreement: destruction and return. When the Teacher deletes their account, all journal posts, messages, portfolio, photos and student records of the class are deleted immediately and permanently; they leave the backups within 30 days at the latest. Before deletion, the Teacher can download the class journal archive and their messages with each parent as a ZIP file (return). Only records that serve to prove consents and acceptances (student/class record number, time, text version; without names or content) are kept for another 2 years.

5. Liability

The Teacher is liable, within the framework of the legislation, to the School, the parents and third parties for posts that breach these commitments. Motivasyon TV may review content reported as breaching the commitment, block access to it, and close the account in case of serious or repeated breaches. Motivasyon TV's liability arising from breach of its own obligations is reserved.

6. Changes and entry into force

If this text changes, the new version is published on this page; until the Teacher accepts the new version, no new posts, messages or items can be added (existing content and downloads remain available). This text is governed by the laws of the Republic of Turkey. Contact: [email protected]
